  6. Plaintiffs rest in Winfrey trial
  7. Cattlemen vs. Oprah Winfrey

  12. An expert witness testified that Paul Engler lost $6.5 million during a
  13. 1996 cattle market crash, which plaintiffs attribute to Oprah Winfrey.

  15. The witness - the 17th to testify thus far - rounded out the plaintiffs'
  16. case in the area cattlemen vs. Oprah Winfrey trial.

  18. The plaintiffs rested at 3:20 p.m., and less than 10 minutes later, defense
  19. attorneys filed motions for the dismissal of the case.

  21. Attorneys on both sides will argue the motions before U.S. District Judge
  22. Mary Lou Robinson on Tuesday. The jury was told not to report back for duty
  23. until Wednesday.

  25. The case has lasted 18 days over four weeks.

  27. The motions filed on behalf of Winfrey, Harpo Productions Inc. and Howard
  28. Lyman say that the plaintiffs have "not presented legally sufficient
  29. evidence for a reasonable jury to find for the Plaintiffs."

  31. In Friday's testimony, certified public accountant Ave Turner said Engler
  32. and his companies Cactus Feeders Inc. and Cactus Growers Inc. lost
  33. $6,512,182 in an 11-week period after the airing of Winfrey's April 16,
  34. 1996, segment on mad cow disease.

  36. Turner said he relied on Engler's expertise in cattle markets to decide how
  37. long a period to look at, a point Winfrey's attorney Charles Babcock
  38. attacked.

  40. Babcock asked why Turner would rely on a man hoping to get money from
  41. Winfrey to determine how much money he should get.
  42.  
  43. "You have to have people who lived through it," Turner answered.
  44.  
  45. He also explained that Engler is asking for damages for live cattle sales
  46. and future sales in that time period.
  47.  
  48. "So Ms. Winfrey is being asked to pay because the market went down, and she
  49. is being asked to pay because it didn't stay down?" Babcock asked.

  51. "There is direct causation," Turner said.
  52.  
  53. The day also brought some clarity - but not much - to confusing testimony
  54. on Thursday about how much other plaintiffs in the case are seeking in
  55. damages.

  57. Bill O'Brien, managing partner of Texas Beef Group, said plaintiffs
  58. affiliated with his company have a new theory of damages.
  59.  
  60. The new formula means TBG and others could get $524,875.81 in damages
  61. instead of the $4.5 million they asked for in opening statements.

  63. It is still unclear whether this is an alternate theory for the jury or the
  64. only one they are to consider.

  66. All parties involved in the case are under a strict gag order and not
  67. allowed to answer questions.

  69. Babcock assaulted the new theory, implying that it changed "because $4.5
  70. million is ridiculous."

  72. "It is absolutely not ridiculous. It is the purest and simplest formula of
  73. calculations on our sales losses you can do," O'Brien said.

  75. Court will not be in session on Monday because of the federal holiday.
